Abstract
L’A., dopo una ricostruzione socio-economica e storico-evolutiva della disciplina dello Statuto dei lavoratori, evidenzia i cambiamenti del modello sindacale e dei rapporti di lavoro ai quali la normativa si è originariamente ispirata. In questo scenario totalmente mutato, l’A. sottolinea la necessità di un nuovo Statuto dei Lavoratori che risponda alle esigenze attuali. In tale Statuto dovrebbe in ogni caso esservi il richiamo, sia pure temperato, alla tecnica della normativa inderogabile, che rimane il vero presidio della tutela dei lavoratori. Sarebbe opportuno, poi, introdurre norme che tutelino sia i lavoratori subordinati sia gli autonomi economicamente dipendenti. Il nuovo testo, altresì, dovrebbe valorizzare il ruolo del sindacato e costruire un sistema ordinato di relazioni sindacali e contrattazione collettiva.
For a new Workers’ Statute
The A., after a socio-economic and historical-evolutionary recon-struction of the discipline of the Workers’ Statute, highlights the changes in the trade union model and in the working relationship which inspired the same legislation. In this changed scenario, the A. stresses the necessity for a new Workers’ Statute, which will meet the current needs. This Statute cannot fail to imply recourse, even if moderate, to the technique of mandatory legislation, which remains the true safeguard for the protection of workers. Furthermore, rules should be introduced to protect both employees and economically dependent self-employed. The new text should also enhance the role of the trade union and build an orderly system of trade union relations and collective bargaining.
