Abstract
I temi affrontati dall’a. sono quelli della rappresentatività sindacale e del consenso, da parte dei lavoratori, nei riguardi del soggetto sindacale e del prodotto del suo agire, all’interno dell’attuale panorama regolativo che ha l’ambizione di estendere quanto più possibile l’efficacia dei contratti collettivi predisposti. Tali temi vengono declinati tenendo conto delle ultime evoluzioni normative e contrattuali (prevalentemente dall’Accordo del 28 giugno 2011 al d.l. n. 76/2013) ed attraverso un percorso di lettura che mette a confronto le norme dell’autonomia sindacale con quelle predisposte dal legislatore per valutare quali siano le conseguenze prodotte sul sistema di relazioni sindacali e quindi cogliere i limiti, le prospettive e le interrelazioni di tali interventi.
Actors, representative power and consensus in the recent union events
The topics addressed by the Author are trade-union representativeness and workers’ consent with respect to union activities and the results arising from them in the context of the present applicable legal framework, which has the ambition of extending the scope of collective agreements to the maximum extent possible. These topics are investigated through taking into account the latest legislative and contractual evolution (especially from the Agreement of 28 June 2011 to Law Decree No. 76/2013), as well as through a comparison between the provisions regulating trade union autonomy and legislative rules, in order to evaluate what are their effects on the system of trade union relations as well as, consequently, to properly understand their limits, perspectives and interactions.
