Abstract
Sullo sfondo dell’identità formale e sostanziale del diritto a pensione di vecchiaia e dei caratteri del sistema di inveramento della garanzia, lo studio analizza il rapporto tra tutela costituzionale e vincolo finanziario come interpretato dall’attualità politica, economica e legislativa, riflettendo sull’assetto delle attuali regole, e sul modello di tutela che esse descrivono, nel quadro del benessere pensionistico a Costituzione formale invariata.
Welfare State Pension and financial constraints following the introduction of Law 214/2014
Once the key features of both the rights to old-age pension and its criteria for implementation have been identified, the study examines the relationship between constitutional protection and financial constraints of resources in light of the current economic, political and legislative situation. Then it compares the present laws on rights to pension, and the welfare state model that derives, with welfare state pension system as outlined in the Constitution.
