Abstract
L’autore svolge una riflessione sul lavoro agile introdotto dalla l. 81/17, allo scopo di accertare se esso costituisce una forma di telelavoro oppure una nuova fattispecie di lavoro subordinato a distanza, confrontandolo, a tale fine, col fenomeno dello smart working. Verifica, poi, se la nuova modalità di svolgimento del rapporto di lavoro impatta sulla nozione di subordinazione e sull’articolazione delle forme giuridiche di svolgimento del lavoro in favore di altri (subordinazione e autonomia di specie parasubordinazione).
The ‘Agile’ Subordination
The author focuses on analysing the agile work introduced by l. 81/2017, in order to ascertain whether it constitutes a kind of telework or a new case of subordinate work at a distance, by comparing it, for that purpose, with the smart working. It then verifies whether the agile work impacts on the notion of subordination and the current articulation of legal forms of work in favor of others (subordination, autonomy, para-subordination).
