Abstract
Scognamiglio indica nel realismo il proprium del suo metodo. Riferito al “fatto” esso sta ad indicare che le fenomenologie sociali vanno considerate per come si comprendono nella realtà, e cioè non come bruto fatto, bensì nel modo in cui esse si lasciano apprezzare sul terreno proprio dell’analisi sociale. Riferito alla “norma”, invece, esso sta ad indicare che le disposizioni normative vanno comprese per il modo nel quale si riferiscono alle fenomenologie sociali, e cioè per il modo in cui esse se le rappresentano e per la qualità degli effetti che vi fanno seguire. La categoria-chiave di questa metodologia realistica è, perciò, quella del trattamento normativo, nel quale prende forma l’autonomia del diritto. Da questa categoria discende una radicale ricomprensione della fattispecie normativa, la quale non è mai riducibile alla somma degli elementi materiali che la compongono, ma assume significato e contenuto giuridici solo dalla specifica veduta dei fenomeni sociali considerati e dal rapporto specifico con la qualità degli effetti che ad essa si fanno seguire.

Referred to “fact”, it indicates that social phenomena must be taken into consideration as they are perceived in reality, that is, not as a raw fact, but in the way in which they can be appreciated on the terrain of social analysis. Instead, regarding the “norm”, it indicates that legislative provisions must be understood for the way in which they refer to social phenomena, that is, for the way in which the provisions represent such phenomena and for the quality of the effects that are determined. Therefore, the key category of this realistic methodology is regulatory treatment, in which the autonomy of law takes shape. This category implies a radical renewed understanding of single legal cases, which never simply amount to the sum of their material elements but acquire legal significance and content only from his specific view of social phenomena considered and from the specific relationship with the quality of the effects that are produced.
